Effective Date: September 1, 2026

These Terms & Conditions govern residential waste collection services provided by Vanguard Waste Management (“Vanguard,” “we,” “us,” or “our”). By establishing service, making payment, maintaining an active account, or continuing to use Vanguard's services, the customer agrees to these Terms & Conditions.

1. Month-to-Month Service

Residential service is provided on a month-to-month basis unless otherwise agreed to in writing. There is no long-term service contract.

Vanguard reserves the right to modify service rates, collection schedules, routes, policies, or these Terms & Conditions upon reasonable notice to customers.

2. Monthly Service Rates

Current standard residential pricing is:

\nFirst 96-gallon cart: $32.00 per month plus applicable tax
\nEach additional cart: $15.00 per month plus applicable tax

Customers enrolled under a promotional or previously agreed rate will remain subject to the terms of that promotion or pricing arrangement unless otherwise notified.

Vanguard reserves the right to adjust rates in the future due to changes in disposal costs, fuel, equipment, labor, insurance, regulatory requirements, or other operating expenses. Customers will be provided reasonable notice of rate changes.

3. Payment & Past-Due Accounts

Residential service is billed monthly. Automatic payments are processed on the night of the 1st of each month using the payment method on file.

Customers enrolled in automatic payments authorize Vanguard to charge the payment method on file for the monthly service amount and any other authorized charges associated with their account.

7-Day Grace Period

Vanguard provides a 7-day grace period following the monthly billing date.

If payment has not been successfully received by the end of the 7-day grace period:

\nCollection service will be paused until the account balance is paid in full.
Vanguard is not required to provide collection service while an account is past due.
Vanguard is not required to collect accumulated trash from collection days missed because the account was past due.
Once the past-due balance is paid in full, service will resume on the customer's next regularly scheduled collection day.

Accounts 30 Days Past Due

If an account remains unpaid for 30 days from the original billing date:

Residential service will be terminated.
Any Vanguard-owned cart(s) will be scheduled for retrieval.
The customer must make Vanguard-owned carts reasonably accessible for retrieval.
The customer remains responsible for any unpaid balance on the account.
Vanguard may require all outstanding balances to be paid before new service can be established.

A declined, expired, locked, or otherwise unsuccessful payment method does not extend the grace period.

Customers are responsible for maintaining a valid payment method and current contact information on their Vanguard account.

4. Collection Schedule

Customers are responsible for having their trash cart(s) at the designated collection location the night before their scheduled collection day.

Vanguard routes may begin very early in the morning. Vanguard is not responsible for returning to collect a cart that was not placed out before the collection vehicle serviced the location.

Collection days and routes may occasionally change because of holidays, weather, equipment issues, road conditions, route growth, safety concerns, or other operational needs.

Vanguard will make reasonable efforts to notify customers of significant schedule changes.

5. Cart Placement

Carts must be placed in a location that is safe and reasonably accessible to Vanguard's collection vehicle.

Customers should:

Place carts at the designated roadside collection point.
Keep carts clear of vehicles, mailboxes, fences, trees, utility poles, and other obstructions.
Ensure carts can be safely accessed by the collection vehicle.
Avoid placing carts underneath low-hanging wires, limbs, or other overhead obstructions.

Vanguard may decline collection when conditions make servicing a cart unsafe or impractical.

6. Bagging of Trash

Household trash should be securely bagged before being placed inside the cart.

Loose household waste may fall or blow from the cart during collection. Vanguard is not responsible for cleaning up loose trash resulting from waste that was not properly bagged or secured.

7. Additional or Excess Trash

Standard monthly service covers the number of carts assigned to or approved for the customer's account.

Customers may place up to two (2) standard kitchen-size trash bags per serviced cart outside of the cart on their regular collection day at no additional charge.

For example, a customer with one cart may place up to two additional kitchen-size bags out for collection. A customer with two carts may place up to four additional kitchen-size bags.

Additional trash exceeding this allowance, oversized bags, contractor bags, additional containers, or unusually large quantities of waste may not be collected unless prior arrangements have been made with Vanguard.

Additional charges may apply for waste exceeding the included allowance.

8. Prohibited Materials

Residential carts are intended for normal household waste.

The following materials may not be placed in Vanguard residential carts:

Hazardous or toxic chemicals
Paint, oil, fuel, or other liquids
Batteries
Tires
Hot ashes or burning materials
Medical or biohazardous waste
Explosives or ammunition
Large amounts of dirt, rock, concrete, brick, or other heavy construction material
Any material prohibited by law, landfill regulations, or disposal facility requirements

Customers may be responsible for additional costs, damages, cleanup expenses, fines, or disposal charges resulting from prohibited materials.

9. Vanguard-Owned Carts

Any cart provided by Vanguard remains the property of Vanguard Waste Management unless otherwise specifically agreed to in writing.

Customers are responsible for reasonable care of Vanguard-owned carts while the carts are assigned to their property.

Customers may be charged for carts that are intentionally damaged, destroyed, removed from the service address without authorization, not returned after service ends, or lost due to customer negligence.

Normal wear and tear is not the customer's responsibility.

10. Customer-Owned Carts

Customers approved to use their own cart are responsible for maintaining the cart in serviceable condition.

Vanguard is not responsible for normal wear, cracking, wheel damage, lid damage, or other damage to customer-owned containers resulting from ordinary mechanical collection unless the damage was caused by Vanguard's negligence.

Customer-owned carts must be compatible with Vanguard's collection equipment.

11. Missed Collections

If Vanguard misses a properly placed cart due to an operational error, the customer should contact Vanguard as soon as reasonably possible.

Vanguard may correct a missed collection by returning for the cart, collecting additional material on the next scheduled collection day, issuing an appropriate account credit, or providing another reasonable solution determined by Vanguard.

A missed collection does not automatically entitle the customer to a full month's refund.

Missed collections resulting from late payment, improper cart placement, prohibited materials, inaccessible carts, or a cart not being placed out on time are not considered missed collections caused by Vanguard.

12. Weather, Road Conditions & Events Beyond Vanguard's Control

Collection may be delayed or suspended because of severe weather, unsafe road conditions, road closures, accidents, equipment failures, landfill closures, government actions, natural disasters, or other circumstances outside Vanguard's reasonable control.

Safety takes priority over scheduled collection.

When practical, Vanguard will resume or adjust service as soon as conditions reasonably allow.

13. Private Roads, Driveways & Property Access

If a customer requests or permits a Vanguard vehicle to enter a private road, driveway, or other private property, the customer represents that the area is reasonably capable of supporting a commercial waste collection vehicle.

Vanguard is not responsible for ordinary wear or damage to private roads, driveways, curbs, or surfaces resulting from the weight or normal operation of collection equipment unless caused by Vanguard's negligence.

Vanguard may refuse to enter any area that its driver determines is unsafe or unsuitable for the vehicle.

14. Service Cancellation

Customers may cancel their month-to-month residential service by contacting Vanguard.

Any outstanding account balance remains due after cancellation.

Any Vanguard-owned cart must remain reasonably accessible for retrieval after service ends.

Payments already made for a billing period are generally non-refundable once service for that billing period has begun, except where Vanguard determines that a refund or credit is appropriate.

15. Suspension or Termination by Vanguard

Vanguard reserves the right to suspend or terminate service for reasons including:

Nonpayment
Repeated placement of prohibited materials
Unsafe collection conditions
Abuse, threats, or harassment toward Vanguard employees or representatives
Unauthorized use, removal, or retention of Vanguard equipment
Repeated violation of these Terms & Conditions
Circumstances that prevent Vanguard from safely or reasonably servicing the property

Termination of service does not eliminate any outstanding balance owed to Vanguard.

16. Changes to Service

As Vanguard grows and routes change, collection days, equipment, service procedures, and other operational details may occasionally be adjusted.

Vanguard reserves the right to make reasonable changes necessary to operate its collection routes safely and efficiently.

Vanguard will make reasonable efforts to communicate significant changes to affected customers.

17. Customer Contact Information

Customers are responsible for keeping their phone number, email address, service address, billing information, and payment information current.

Vanguard may use email, text message, phone, or other reasonable methods to communicate billing notices, route changes, service interruptions, policy changes, and other account information.

Customers are encouraged to check their spam or junk email folders for Vanguard communications.

Failure to receive or read a notice does not eliminate the customer's responsibility for payments or compliance with these Terms & Conditions.

18. Limitation of Liability

To the fullest extent permitted by law, Vanguard will not be responsible for indirect, incidental, or consequential damages arising from delayed, interrupted, suspended, or missed collection services.

Nothing in these Terms & Conditions is intended to waive responsibility that cannot legally be waived under applicable law.

19. Acceptance of Terms

By establishing an account, submitting payment, maintaining an active account, receiving service, or continuing to use Vanguard's residential waste collection services, the customer acknowledges that they have received, understand, and agree to these Terms & Conditions.
